1. Acceptance of Terms
These Terms and Conditions of Use (“Terms”) govern access to and use of the website golfpassport.mx, the Golf Passport mobile application available on the Apple App Store and Google Play Store, and any other services provided by Golf Passport LLC (“Golf Passport”, “we”, “our”, or the “Company”).
By accessing, downloading, or using any of our Services, the user (“User” or “you”) agrees to be bound by these Terms. If you do not agree, you must refrain from using the Services.
2. Definitions
For purposes of these Terms:
Services: The website, mobile application, memberships, coupons, additional packs, and any other features or benefits provided by Golf Passport.
Affiliated Courses: Golf clubs participating in the Golf Passport program that offer benefits to Users.
Membership: The right acquired by the User to access Golf Passport benefits for a defined period.
3. Memberships and Validity
3.1 Annual Membership
The membership is valid for twelve (12) months from the activation date.
During this period, the User may access benefits offered by affiliated courses, subject to the conditions published on the app and website at the time of use.
3.2 Additional Coupon Packs
Validity: Twelve (12) months from the purchase date.
Usage condition: An active membership is required. If the membership expires or is canceled, coupons will be suspended until the membership is reactivated.
Renewals: Upon renewal, the system will apply coupons from the new membership first, followed by any remaining coupons from previous packs, provided they have not expired.
4. Permitted Use
The User agrees to:
Use the Services solely for personal, lawful, and non-commercial purposes
Not sell, resell, transfer, sublicense, or share their account, membership, or coupons
Comply with the rules and conditions established by each affiliated course
Golf Passport reserves the right to suspend or terminate accounts that violate these Terms.
5. Intellectual Property
Unless otherwise stated, Golf Passport LLC and/or its licensors own all intellectual property rights related to the Services and their content.
The User may not:
Reproduce, copy, modify, distribute, or create derivative works without prior written authorization
Use trademarks, logos, or trade names without express permission
6. User Content
By submitting reviews, comments, or any content through the Services, the User:
Represents that they have the necessary rights to publish such content
Ensures the content does not infringe third-party rights or contain unlawful or inappropriate material
The User grants Golf Passport a non-exclusive, royalty-free license, for the duration necessary to operate and promote the Services, to use, reproduce, and display such content.
Golf Passport may remove any content that violates applicable law, these Terms, or internal policies.
7. Cookies and Personal Data
Golf Passport uses cookies to enhance the User experience, in accordance with its Privacy Policy.
Personal data will be processed in compliance with applicable laws and solely for the purposes described in such policy.
8. Responsibility and Limitations
Golf Passport will use reasonable efforts to provide the Services with adequate availability and functionality; however, it does not guarantee that the Services will be uninterrupted or error-free.
Golf Passport operates as a technology intermediary that facilitates access to benefits offered by independent third parties (including golf courses and partner brands), who are solely responsible for their conditions, availability, pricing, and policies.
Accordingly, Golf Passport shall not be liable for acts or omissions attributable to such third parties, including but not limited to cancellations, changes in conditions, lack of availability, denial of service, or any failure by such third parties.
Nothing in these Terms limits any rights that Users may have under applicable law.
9. Links
Linking to the Golf Passport website is permitted only if:
The link is not misleading or deceptive
It does not imply false endorsement or affiliation
It does not harm the reputation of Golf Passport
Golf Passport may request removal of any link that does not comply with these conditions.
10. Modifications
Golf Passport may modify these Terms at any time. Updates will be published through official platform channels.
In the event of material changes affecting essential aspects of the service, such changes will not adversely affect benefits already acquired or confirmed by the User, except where required due to causes beyond Golf Passport’s control.
Continued use of the Services constitutes acceptance of the updated Terms.
11. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the United States of America.
Notwithstanding the foregoing, Users acting as consumers may exercise any rights available under applicable laws in their country of residence, including consumer protection laws in Mexico, Canada, Colombia, Panama, and other jurisdictions.

13. Content, Benefits, and Partner Availability
The Services are continuously evolving, and information may be updated or modified from time to time.
The User acknowledges that:
Benefits, promotions, affiliated courses, and conditions depend on third parties and are subject to availability
Applicable conditions are those displayed at the time of consultation or use
Golf Passport does not guarantee the indefinite availability of any specific benefit or partner; however, it will act in good faith and avoid unjustified changes that materially affect benefits already acquired or confirmed by the User.
14. Nature of the Service
Golf Passport LLC provides a technology platform that enables Users to access information and potential benefits offered by independent third parties.
Golf Passport is not a provider of golf services and does not own, operate, or control any golf courses, nor does it guarantee access to them.
All benefits, discounts, promotions, participating courses, and related conditions (including availability, schedules, restrictions, pricing, and booking policies) are determined solely by third parties and may be modified, restricted, or canceled.
Membership grants access to the platform, not a guarantee of any specific benefit.
Information displayed within the app is for informational purposes only and may not reflect real-time conditions. Final availability is subject to confirmation by the relevant third party.
Golf Passport shall not be liable for lack of availability, changes in conditions, denial of service, errors in third-party information, cancellations, or any third-party failures.
15. Promotions and Advertising
All promotions, discounts, and benefits are subject to specific conditions, availability, and restrictions established by the third parties offering them.
Golf Passport will make reasonable efforts to ensure information is accurate and up to date; however, promotions may be subject to reasonable changes.
Promotions do not constitute a guarantee of availability but rather an opportunity to access benefits subject to third-party confirmation.
16. Cancellations and Refunds
Unless otherwise stated, memberships are non-refundable once they have been used or once a first redemption has occurred.
However, Users may request case review in situations where issues are directly attributable to Golf Passport and prevent access to the contracted service.
Specific policies may vary depending on promotions or particular conditions, which will be disclosed at the time of purchase.
