1. Acceptance of Terms

These Terms and Conditions of Use (“Terms”) govern the access to and use of the website golfpassport.mx, the mobile application Golf Passport available on the App Store and Google Play, as well as any other service provided by Golf Passport LLC (“Golf Passport,” “we,” “our,” or “the Company”).

By accessing, downloading, or using any of our Services, the user (“User,” “you,” or “your”) agrees to comply with these Terms. If you do not agree, you must refrain from using the Services.

2. Definitions

For the purposes of these Terms:

  • Services: the website, mobile app, memberships, coupons, additional coupon packs, and any other functionality or benefit provided by Golf Passport.

  • Affiliate courses: golf clubs participating in the Golf Passport program that offer benefits to Users.

  • Membership: the right acquired by the User to access Golf Passport benefits for a set period.

3. Memberships and Validity

3.1 Annual Membership

  • Duration: 12 months from the activation date.

  • During this period, the User may access exclusive benefits offered by affiliate courses, according to the conditions in effect as published in the app and website.

3.2 Additional Coupon Packs

  • Validity: 12 months from the date of purchase.

  • Usage condition: the annual membership must be active. If the membership expires or is canceled, the coupons will be suspended until the membership is renewed or reactivated.

  • Renewals: upon renewal, the system will use the 4 coupons included in the new membership first, and then any remaining coupons from the previous pack, provided they have not expired.

4. Permitted Use

The User agrees to:

  • Use the Services solely for personal, lawful, and non-commercial purposes.

  • Not sell, resell, transfer, sublicense, or share their account, membership, or coupons with third parties.

  • Comply with the rules and conditions of use established by each affiliate course.

Golf Passport may suspend or terminate the User’s account for any breach of these provisions.

5. Intellectual Property

Unless otherwise stated, Golf Passport LLC and/or its licensors hold all intellectual property rights over the Services and their content.
The User shall not:

  • Reproduce, copy, modify, distribute, or create derivative works from the content without prior written authorization from Golf Passport.

  • Use registered trademarks, logos, or trade names without express permission.

6. User-Generated Content and Comments

By submitting opinions, comments, or any type of content through the Services, the User:

  • Warrants they have all necessary rights to publish such content.

  • Ensures the content does not infringe on third-party rights or contain unlawful, defamatory, offensive, or inappropriate material.

  • Grants Golf Passport a non-exclusive, irrevocable, and royalty-free license to use, reproduce, modify, and distribute such content in any format or medium.

Golf Passport reserves the right to remove any content deemed unlawful, contrary to these Terms, or to our internal policies.

7. Cookies and Personal Data Processing

Golf Passport uses cookies to optimize the User experience, in accordance with our Privacy Policy.
The processing of personal data will be carried out in compliance with applicable law and only for the purposes described in said policy.

8. Liability and Limitations

Golf Passport does not guarantee that the Services will be uninterrupted, error-free, or technically flawless, nor that affiliate course promotions will always be available.
In no event shall Golf Passport be liable for:

  • Economic losses, indirect damages, or consequential damages arising from the use or inability to use the Services.

  • Non-compliance, cancellations, or changes to benefits by affiliate courses.

9. Hyperlinks

Linking to the Golf Passport website is permitted only under the following conditions:

  • The link is not misleading and does not imply false sponsorship or association.

  • The link does not negatively affect Golf Passport’s image or reputation.

Golf Passport may request removal of any link at any time if these conditions are not met.

10. Modifications

Golf Passport may modify these Terms at any time. The current version will always be available on the website and in the application, indicating the date of last update. Continued use of the Services after changes are published constitutes acceptance of the updated Terms.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States of America.
Any dispute shall be resolved by the competent courts of Florida, and the parties waive any other jurisdiction that may apply.
